Step 1: Understand why you were refused
The refusal letter from the Department of Home Affairs will set out the reasons for the decision. Read it carefully — this is the most important document you have. The reasons will determine which options are available to you.
Common reasons for refusal include: not meeting character requirements, insufficient financial evidence, health requirements not met, incomplete documentation, or failure to satisfy a specific visa criterion.
Step 2: Consider your review options
Depending on the visa type, you may be able to apply for a merits review at the Administrative Review Tribunal (ART). The ART can review the decision independently and may set it aside, vary it, or send it back to the Department.
There are strict time limits for lodging a review — often as little as 21 days from the date of the refusal. Don't delay.
Step 3: Consider a fresh application
In some cases, particularly where the refusal was due to missing or insufficient documentation, it may be more practical to lodge a new application with the right supporting evidence. A migration lawyer can advise whether this is the better path.
Step 4: Get legal advice early
Migration law is complex and the consequences of getting it wrong — including being barred from future applications — can be serious. If you've received a refusal, getting advice from a registered migration lawyer as early as possible gives you the best chance of a positive outcome.
